Hollister's Attorney Seeks New Trial in Murder Case

(ATCHISON, Kan.) An attorney has filed an appeal with the Supreme Court in the murder case involving Roger Hollister.

Hollister was convicted in March 2011 for the murder of Patrica Kimmi and is now serving a life sentence without parole.

Atchison County Prosecuting Attorney Jerry Kuckelman said it is mandatory to appeal capital murder cases, and he was not surprised to see the appeal.

Hollister's attorney submitted their appeal and Kuckelman said they have 30 days to respond.

The appeal cites insufficient evidence and errors in the closing arguments deprived Hollister of a fair trial.
